Terms & Conditions

These Terms & Conditions govern your engagement with Mahkota Family Law Services. We have written them as plainly as possible, but please read carefully. If anything is unclear, we are happy to discuss it with you directly.

1. Definitions

In these Terms & Conditions, the following terms carry specific meanings:

  • "Mahkota" or "we" refers to Mahkota Family Law Services, operating from Level 14, Menara Maxis, Jalan Ampang, 50450 Kuala Lumpur.
  • "Client" or "you" refers to any individual or entity engaging our services or using our website.
  • "Services" refers to legal consultation, mediation, representation, and related family law matters as described on our website.
  • "Agreement" refers to the legally binding relationship formed between you and Mahkota upon engagement.
  • "Website" refers to the site accessible at mahkota.biz.

2. Acceptance of Terms

By accessing our website, submitting an enquiry, or engaging our services, you confirm that you have read, understood, and agree to these Terms & Conditions. If you do not agree, please do not use our website or services.

You confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. If you are acting on behalf of another individual or entity, you represent that you are authorised to do so.

3. Service Description

Mahkota provides professional family law services across three primary areas:

  • Family Consultation & Mediation — structured sessions for families navigating change (RM 580)
  • Separation & Dissolution Representation — considered legal support for individuals undergoing separation or dissolution of marriage (RM 1,250)
  • Comprehensive Family Matters Package — complete case management for households facing several intertwined family law matters, including hadhanah and nafkah considerations (RM 1,920)

Services are delivered in Malaysia. The specific scope of each engagement will be confirmed in writing before work commences. We reserve the right to decline or adjust the scope of an engagement where circumstances require.

4. Client Responsibilities

To allow us to serve you well, we ask that you:

  • Provide accurate, complete, and timely information relevant to your matter
  • Inform us promptly of any changes in circumstances that may affect your case
  • Respond to our communications within a reasonable timeframe
  • Refrain from engaging conflicting legal representation for the same matter without notifying us
  • Use our website and services only for lawful and appropriate purposes
  • Not misrepresent yourself or your situation

5. Intellectual Property

All content on our website — including text, design elements, structural layouts, and branding — is the property of Mahkota and is protected under applicable Malaysian intellectual property law. You may not reproduce, redistribute, or repurpose any content without our prior written consent.

Documents and materials we prepare specifically for your legal matter remain our professional work product until fees are settled in full. Upon completion and full payment, agreed deliverables are provided to you for your personal or legal use.

6. Fees & Payment

Our published service fees are stated in Malaysian Ringgit (RM) and are as follows:

  • Family Consultation & Mediation — RM 580
  • Separation & Dissolution Representation — RM 1,250
  • Comprehensive Family Matters Package — RM 1,920

Fees are payable as agreed at the time of engagement. We will provide a written fee arrangement before any chargeable work begins. For complex matters, staged billing arrangements may be agreed in advance. Any disbursements (court fees, filing charges, courier costs) will be communicated and invoiced separately.

Refunds are considered on a case-by-case basis and will reflect the work completed to the point of any variation or withdrawal. Refund requests should be directed to us in writing.

7. Engagement Terms

A formal engagement commences once you and Mahkota have agreed in writing on the scope of services and fees. Until that point, any communication remains preliminary and does not constitute the formation of a client-solicitor relationship.

  • Changes to agreed scope must be requested in writing and confirmed by us before work on the revised scope begins
  • We will keep you informed in clear terms throughout your matter, and we welcome questions at any stage
  • Confidentiality is maintained at all times in accordance with our professional obligations under the Legal Profession Act 1976 and Bar Council guidelines
  • We aim to respond to communications within 2 working days

8. Disclaimers

The information on our website is provided for general reference only and does not constitute legal advice. Each family matter is unique; please consult with us directly before acting on any information.

While we approach every matter with care and professionalism, we cannot warrant specific outcomes in legal proceedings. Family law involves the decisions of third parties, including courts, which are outside our control.

9. Limitation of Liability

To the extent permitted by Malaysian law, Mahkota's liability in connection with our services is limited to the fees paid by you for the specific service in question. We are not liable for indirect, consequential, or incidental losses arising from your use of our services or website.

Nothing in these Terms limits liability for fraud, gross negligence, or any matter that cannot lawfully be excluded under Malaysian law.

10. Indemnification

You agree to indemnify and hold Mahkota, its practitioners, and staff harmless from any claims, losses, or expenses (including legal costs) arising from your breach of these Terms, your provision of inaccurate information, or your misuse of our services or website.

11. Termination

Either party may bring an engagement to a close by providing reasonable written notice. In such circumstances:

  • Fees for work completed to the date of termination remain payable
  • We will return documents belonging to you in a timely manner
  • We will provide a brief handover to assist you in transitioning to alternative counsel if required
  • Professional obligations of confidentiality survive termination indefinitely

12. Dispute Resolution

We hope any concerns can be resolved through direct, open conversation. If you have a concern about our services, please contact us in the first instance and we will do our best to address it promptly and fairly.

Should a dispute not be resolved informally, it shall be subject to the laws of Malaysia and the jurisdiction of the Malaysian courts. Where appropriate, we may suggest referral to the Malaysian Bar's Complaints Committee or an independent mediator.

13. General Provisions

  • Entire agreement: These Terms, together with any written engagement letter, constitute the full agreement between you and Mahkota for the services described.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision at any time does not constitute a waiver of that provision.
  • Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent.
  • Notices: Formal notices should be sent in writing to our address or via email to [email protected].

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via our website with a revised effective date. Continued use of our services following any change constitutes acceptance of the updated Terms. We recommend checking this page periodically.
